| The annual ban on open burning is effective June 1, 2008 through August 31, 2008. No open burning permits will be issued by the Frederick County Health Department. Previously issued open permits ARE NOT in effect during this time period.
The annual ban, which is prescribed by the Maryland State Air Quality regulations, first went into effect in June 1995. The ban extends throughout the Metropolitan Washington Air Quality Region and is designed to reduce the high ozone levels that affect the region during the summer months.
This ban does not apply to small recreational fires such as campfires, the use of barbeques, or gas grills. However, these activities still must comply with the Frederick County and State Fire Prevention Code.
An open burning permit is required from the Frederick County Health Department for all other times of the year when burning is allowed regardless of the material being burned.
Violation of the open burning ban or open burning without a permit is subject to a civil citation of $500 issued through the Frederick County Fire Marshal's Office or up to $500 issued through the Frederick County Health Department. A penalty up to $25,000 can be levied under Maryland State Regulations. |
